TERMS & CONDITIONS

1. The space as stipulated in this agreement is to be used only for the Exhibitor named in the contract, during the dates specified- no subleasing or substitution.

2. The price paid for the exhibit space shall be for exhibit space only.

3. For an additional charge, the KABCB(Keep Austin Bizarre Christmas Bazaar) committee will provide a convenient electrical outlet.

4. All fixtures in exhibit area must be provided by the Exhibitor (i.e. walls, tables, chairs, lights and extension cord). Only exhibit space is provided (And outlet if paid for by vendor).

5. All improvements erected on said space shall be done at the expense of the Exhibitor; subject, however to the

approval of the KABCB committee. Upon termination of the exhibit, all of said improvements must be removed at

the expense of the Exhibitor, leaving the space in as good condition as it was when it was first occupied.

6. Only approved goods may be sold and displayed or advertised.

7. We reserve the right to remove or prohibit exhibits which for any reason are deemed objectionable and in KABCB judgment may detract from the general character of the festival. This reservation includes, conduct, printed matter, or anything in the opinion of the KABCB committee that is unacceptable.

8. The Exhibitor is entirely responsible for the space leased and agrees to reimburse the KABCB for any damages

which occur in the provided space.

9. The Exhibitor will be solely responsible for their merchandise and exhibit. The KABCB will not assume responsibility for theft, weather damage, or other damage.

10. The lease, these rules and regulations, and any others prescribed by the KABCB shall be final and violation thereof shall constitute a default of the lease. Violation can mean immediate cancellation of any agreement and forfeiture of all moneys. Should litigation in sue arising out of this contract or any of its provisions then venue is hereby set in Travis county Texas. If KABCB prevails then vendor will be responsible for all damages, cost and attorney fees. Should any injury to any persons, reputation or property of any person or entity occur as a result of vendors activities pursuant to this contract then vendor should be solely responsible for the same holding harmless and indemnifying the KABCB committee.

11. BOOTH SET-UP: Each is responsible for setup, take down and clean up of his/her stand. You will be notified when it is safe to bring your vehicles into the loading and unloading dock. Loading/setup times will be in the confirmation letter sent to you prior to the event (Oct.5). You must remove your vehicle immediately after unloading your merchandise. Parking is not provided.

12. Vendors must keep their own spaces clean throughout the event and remove trash daily from their booth.

13. The Keep Austin Bizarre Christmas Bazaar Committee will not be held responsible for any injury, loss, or damage that may occur to the vendor or to the vendors employees or property from any cause whatsoever prior to, during, or subsequent to the period covered by the vending contract. This vendor hereby releases, holds harmless, and indemnifies KABCB committee. The Vendor hereby releases holds harmless and indemnify each of them against any and all claims from such loss, damage or injury from participation in the event.

NO VENDOR MAY CLOSE THEIR BOOTH EARLY!

14. No drugs or firearms allowed on grounds

15. Refund Process: Inclement weather or Acts of God, or closure of event by government agencies outside of the

control of KABCB comity may result in the cancellation of event. A $50 non-refundable application fee will be applied to any canceled application. Cancellations made between November 5 November 13 will forfeit 50% of total fees. Cancellations made after November 14(including the day of the event) will NOT be entitled to a refund.

All denied applications will receive a full refund. Vendors will be charged $30 for a returned check.
